  The Data Protection Act 1998 is a complex piece of legislation. Failure to comply with the Act can lead to a variety of sanctions, the most serious of which is the imposition of criminal liability. In addition, when it comes to procurement many organisations now insist on evidence of data protection compliance before accepting a tender for work.
   
  As a first stage of compliance, employers need to ascertain whether they are required to register with the Information Commissioner and, if so, to proceed with registration. This process can be carried out at: http://www.dataprotection.gov.uk
   
  Secondly, employers need to conduct an audit of their data handling and implement the audit assessment. The Information Commissioner defines a data audit as:

"A systematic and independent examination to determine whether activities involving the processing of personal data are carried out in accordance with an organisation's data protection policies and procedures, and whether this processing meets the requirements of the Data Protection Act 1998".
